Good enough time as any to remind old and new here my belief that the words conspiracy and theory need to be separated always and forever. Framers of real conspiracies coined the term to deride those who were on to something.

My computer has been rough all day. When it goes down I pay more attn to CSpan, where Reid recently suspended business in the senate in order to resume torture/FBI hearing that repubs have been trying to interrupt with other votes on floor.

I was clicking Wexler's Co-Sponsor article downthread and all my open ff browsers froze, the message in the lower corner was, "waiting for widget...", then my computer froze and I went to emergency shutdown. Restarting led to "cannot find operating system". Restarted again after power and cat5 removal for 10 minutes and f1 boot sequence info to find only one drive listed, followed instructions provided by xp pro to inspect computer for new hardware and software including viruses and restart came through. Checked system drives, one simply missing, and went to system restore where I received the message that the second drive could not be restored. Instead, I reconnected without the second drive and all is well again... only thing is that the drive that quit was only 8 months old set up as a "mirror" while the original is 9 years and at 96% full... I believe this was a simple premature crash of that drive, but I'm throwing it out in case this becomes a pattern.

Our representative here in the third district, Oregon, refuses to call for impeachment of the war criminals in the White House. He mocks Dennis Kucinich whenever he can. Blumenauer, during an interview for the Willamette Weekly with John Sweeney and myself, said that Kucinich only got about 2% of the vote for President and based on that, said impeachment was not an issue. This is our representative in the most progressive district in the state, if not the country. He got over 85% of the vote in the primary on May 20th of this year. This was one of the reasons I finally left the democratic party and became an independent. I cannot stand the cocktail democrats who call themselves progressives and their constituents buy into it----it boggles the mind!

We, Individuals for Justice, have been protesting outside of Blumenauer’s office for almost a year now, holding him accountable for his actions. We have been arrested, threatened, ignored and frozen during the cold months but we will remain until bush and his dick are out of office or Blumenauer calls for impeachment.

Blumenauer is an opportunist and people in his district are being fooled by his statements on how hard he is trying to stop this war in Iraq. He is a liar, there is no war in Iraq, only occupation and genocide of the people of this destroyed nation. He must be replaced by a peacemaker.

Bottom line---Blumenauer, Pelosi, Reid are punks, Kucinich is a hero!

How about just upholding his oath to protect and defend the Constitution of the United States of America from all enemies foreigh and domestic.

On this I give Kucinich all the credit he deserves which is magnanamous, but to say he is hero he is not; not for performing his sworn duty I won't say that. His, Wexler, Conyers, and all the rest, jobs are to right wrongs when they discover them NO MATTER WHO THE WRONG DOER(S) IS/ARE.

Congress as a whole, including the Democratic Congressional Representatives, have allowed the Bush Administration to trash our House of Government (with lies, deceptions and secrecy that launched an illegal war and illegal government acts, such as secret “renditions”, secret prisons, torture, indefinite detentions, etc.), strip our government of meaningful Constitutional checks and balances, the Bill of Rights, government responsibilities and accountability, and strip our federal budget and economy
(by allowing private interests to pillage our taxpayer dollars, public assets, and our economy at will, with no responsible oversight).

Congress has made no effective attempt to correct George W. Bush's arrogant assertion of unlimited Executive power and his characterization of the U.S. Constitution as “just a goddamned piece of paper”. Congress has tolerated unprecedented numbers of serious violations of our Constitution and of federal statutes and has failed to apply the Constitutional prescription for gross abuse of power, namely Articles of Impeachment. Congress has allowed the Bush Administration to violate federal statutes, treaties, and our Constitution with total impunity.

A core assumption of our beloved U.S. Constitution is that no man is above the law. In fact, impunity is odious not only to our Constitution or to democratic principles in general, but to ANY semblance of civilized governance. When, in the context of so many unprecedented violations of law and the Constitution, impeachment continues to be “off the table”, civilized governance has been removed from the menu.

Impunity is not a sustainable social value. Therefore, to re-assert the basic premise that no man
is above the law, to restore our Constitution and legitimate and responsible governance, to restore rule of law and our American values, to restore our reputation in the world and our own faith in our country and in Congress, the US House of Representatives must act today to accept Kucinich's ( June 9th 2008) Articles of Impeachment !

NOW IS THE TIME for all good citizens to call their Representative in Congress and demand impeachment and the restoration of responsible governance. NOW IS THE TIME for our elected Representatives to exercise their Congressional Oath to uphold the U.S. Constitution...

The Democratic House leadership is preparing to stick the articles of impeachment raised by Rep. Dennis Kucinich Monday night against President Bush on the same shelf that they stuck a similar effort the Ohio Democrat filed last year against Vice President Dick Cheney.

House Majority Leader Steny Hoyer told reporters today that the 35-count indictment of Bush, which took Kucinich more than four hours to read on the House floor, would be forwarded to the House Judiciary Committee. The Democratic leadership has opposed impeachment as an unhelpful distraction; the Judiciary Committee is unlikely to pursue further action.

Kucinich, using arguments similar to those he employed last year against Cheney, says Bush misled Congress and the American people into war with tales of weapons of mass destruction in Iraq.

House leaders were caught off-guard last year when Republicans voted to take up the Cheney impeachment in order to force a debate that could have proved awkward for Democrats. They avoided that debate by sending it to the Judiciary Committee.

Hoyer said today that Kucinich had "an absolute right" to raise the issue. But he questioned whether it made sense to spend time on it during what he called "the waning months" of the Bush administration.

Hoyer said the administration has one of the worst records of any administration in his lifetime, or maybe ever. He said Congress has conducted wide-ranging oversight since Democrats took over last year.

It was a joy to read Congressman Dennis Kucinich 35 Articles of Impeachment, and the wonderful opinions of so many intelligent people. The problem is that the only place that people can read this, is on After Downing Street, and a few other Liberal Web Sights.

When news of the articles of impeachment first broke last night, I went to my Yahoo news page, NOTHING. I do not have cable, so I turned on broadcast television, NOTHING. Later I went to my Google news page. They had a small story which said that Dennis Kucinich introduced 35 articles of impeachment, more or less as a token gesture, and it was not going to get anywhere. That was it! This morning I anticipated that it would be a front page story. To my dismay, the front page story was, about how warm the weather was in the North East.

We do not have a free press in this country any more. The powers that be, have taken them over. If we do not have a free exchange of ideas through Television, and the traditional press, Democracy is dead. Thomas Jefferson said, "Whenever the people are well informed, they can be trusted with their own government." As it stands today, most people in the world, know more about what is going on in this country than we do.

The most important things are the impeachment of Bush and Cheney, and the ending their illegal, and immoral War. The second most important thing is to take back our media. We must change the laws that allow media monopoly, and pass laws that will insure that the peoples interests are served. We have lost all of television, and most of our newspapers, and magazines to special corporate interests. We still have the Internet, and our word of mouth. They are trying to take over the Internet. Don't let it happen.

Read as much as you can, pass the word, organize, protest, vote for progressive candidates, holler, and shout. We have a greater powers than the people who would like to control us. We out number them a million to one. If we want to, we can hold them to account. We can investigate, impeach, indite, and than lock the bastards up. If politicians stand in our way we can move them aside. Nancy Pelosi should have been pushed out of the way, as soon as she declared that impeachment was off the table. Voters have to tell politicians that we are in charge. Tel them if you can not serve We The People, We The People will find someone to replace them. We are the boss. Do as we say, or come next election, your fired. We Should be in charge and, we should take charge of our representatives in Congress, and insist that they support Congressman Dennis Kucinich 35 Articles of Impeachment. We don't have to kiss their ass, or say pretty please, we need to tell them to go to work, or punch their card and go home.

CQPolitics.com is reporting that the GOP and Dem leadership is going to force a full re-reading of the articles of impeachment for the purpose of "wasting time" and stalling progress.

In an effort to highlight the time they say Democrats are wasting, House Republicans will make the clerk read every word of Dennis J. Kucinich ’s resolution seeking to impeach President Bush.

But not until the very end of the day.

Then, at the end of the day, the Ohio Democrat will call up his articles of impeachment and Democrats will refrain from making a routine request to waive the reading of the document.

Rep. Wexler announced today that he has signed on as a co-sponsor. Between Rep. Wexler and the 26 co-sponsors of H.Res. 333, why is Rep. Kucinich unable to find enough support to force this resolution forward in a productive and compelling way.

Do the pleas of the citizens of this country for change mean nothing to these people. Are they so warped by the beltway that we cannot leverage them in any way? I am months, nay, years and years and years beyond angry.

The HuffingtonPost "Daily Brief" email published at 11 am today, the day after the evening during which U.S. Representative Kucinich presented 35 Articles of Impeachment against President Bush on the floor of the House, didn't include a single reference to that historic event.

I replied - it was rejected.

I have deleted my bookmark for HuffingtonPost and won't be getting their email again.

It's just another democrat operative outfit that couldn't care less about accountability for the crimes of Bushco, or truly restoring the integrity of our Constitution and system of government.

Their only goal is to help their anointed one seize the same fraudulent powers crafted by the handlers of the current Pretender-in-Chief. I'm sure Arianna is regularly salivating at the prospect of getting her share of the credit for helping to install the next one.

Less than two minutes after Kucinich's impeachment articles was finished being read, starting at 7:30 PM CDST and ending just about midnight here in Texas, C-SPAN had a Cleveland Plain Dealer news reporter in their Washington bureau on the phone who calmly announced that the bigwigs in the democratic party and in congress "are UNHAPPY with Kucinich," saying "bush will be gone in a few months anyway," "impeachment proceedings now would look vindictive," "impeachment proceedings might mess up the November election."

John I know you're not a liberal democrat weenie so this next is for those who are...."you stupid liberal democrat weenies need to fire, recall, ride em out tarred and feathered on a rail if necessary and get new people in congress because the people you have now are traitors to liberals, democrats, and this nation in general."

There was no quorum present but Kucinich's resolutions were actually VOTED DOWN soundly by the congressional members that WERE present...so the vote on Ku's impeachment articles are "supposed" to happen sometime today. My bet is that all 35 articles are referred to and get buried "AGAIN"

So with this said, I'll keep on going with my "countdown to impeachment club or ha ha not today" right up to January 20, 2009 and wave bye bye to bush and cheney, having no other choice, like the rest of the sheep...because the democrat bigwigs at the top of the party and in congress and apparently their sheep herds obviously prefer to let bush, cheney, et al ux, end their terms in triumph and walk away scot free rather than getting any dirt on their hands. Nancy - By not pursuing impeachment hearings against George W. Bush you are a complicit enabler of this illegal regime, and you are a disgrace to the American people and the Constitution of the United States. Honor your Oath to the Constitution!

Language and framing are critical in any arguement. Pelosi, et al., have from the beginning referred to Impeachment as if it's a choice, based on political calculus. It is not. It is the RESPONSIBILITY of Congress to impeach if crimes have been committed. For better or worse, it is their responsibility.

Why did the assholes in San Francisco vote for Nancy the whore in the primary? Are they saving themselves for Cindy? What the hell is wrong with the people in this country?

More than a few things of the past 13 years and especially these past two years have left me a bit awed 4peace.

A president that obviously hates the citizenry he supposedly represents...he's going to veto the unemployment benefits extension again even though its being submitted as a single indepentent bill. Both a congress and president that let corporations trample on the people that must, because they have no other choices, but to buy their products. I could add more but we all know what they are without my bringing them up again.

But as to the unanswered why...the entire spectrum, economic, trade, job losses, price gouging, all of it...being thrown at us constantly, has muddied the waters so much who could even venture to "guess" why much less actually know why.

The only thing I can say for absolutely sure is that my guns are oiled and ammo is at the ready.

In actuality impeachment proceedings should have started in the congress within six months in 2004 after the onset of war in Iraq began when bush's and cheney's lies and manipulations were first discovered...not some four years later when it is all but too late to get rid of them.

Have you Dik, or anyone else even asked yourselves "why Conyers, because of his "several failures" to take actions on valid charges and issues, failing to uphold his sworn oath, hasn't been unseated as Chairman of the Judicial Committee and someone like Kucinich or Wexler willing to perform replacing him? The power "to unseat" a congressional member that sits as a committee chairman exists as surely as the power exists "to put" a congressman in the position as a committee chairman.

Surely a condescending Libertarian smartguy like you has an answer to "THAT" question.

Instead of going along with the program status quo business as usual, that same question may also be applied and asked as to why the democrats in congress who chose their speaker, won't now unseat asskissing bushite Pelosi as Speaker of the House for all her failures to comply with and uphold our constitution and law, and the wishes and demands of tens upon tens of millions of our citizens to go forward with impeachment.

In addition to the AOL poll, there is now a MSNBC poll on Bush's impeachment as well. Currently there are 89% pro-impeachment votes.

1) A new set of monumental criminals are ready and waiting in the wings.

2) Who will re-instate the devastated tabula rasa of innocent nations? Who will bring sanity back to the lives of the barely living who have seen DU and Daisy Cutters rained down upon their loved ones? Who will pay them fair and just compensation for their cataclysmic loss, pain and suffering?

And those today waiting in the wings have each indicated their desire to nuclear decimate Iran. Pakistan can't be too far behind judging from the continuous mantras of "loose nukes" and "terrorists" emanating at an accelerated pace from its mightiest think-tanks.

3) Therefore, unless you kill the DNA, this round of 'Roundup' is only going to temporarily do away with this crop of deadly blood-sucking weeds!

4) And while for the Americans, it has taken some 4000 to 10000 dead, some say considerably more if the paid mercenaries of the private armies are counted, plus the 3000 innocent who died on 911, the innocent dead in Iraq, Afghanistan, and the poisoning of their habitat and their DNA with DU for all future time has taken at least three to four order of magnitude greater toll.

As part of atonement that barely even reaches the level of sincerity that a victim can even begin to accept, first in principle, and then in execution, full restitution and compensation for all this pain and suffering must equally be on the table!

Otherwise, perhaps this impeachment exercise may fool the American public about the famed American democracy in action – it fools no one else!

Least of all the victims - from Cambodia to Iraq, and heavens forbid, now Iran and Pakistan. The impeachment of Nixon did as much for Laos and Vietnam, as impeachment of Bush for Iraq and Afghanistan.

5) A bunch of Zionofascist criminals can so easily hijack a superpower nation with a 'legal' coup d'etat that isn't even recognized as such – something more than just impeachment is necessary!

The system is not only broken, it was crippled at birth – for it is so easily hijackable - from Wounded Knee to Iran, with new "Pearl Harbors" cleverly used for "imperial mobilization" from the USS Maine to 911 to the new nookular '911' that Bush keeps warning the Americans and the world about!

Unless recognition of all of these afore-stated points is driven home as part of this 'spraying of Roundup' on this crop of criminals, new set of killer-weeds lie just beneath the surface.

Unless the media, the think-tankers, the oped-writers, the NYT to WP editorial chain, the ABC to FOX news chain, and the William Kristol to all the PNAC authors to Donald Rumsfeld to Dick Cheney to Zbigniew Brzezinski to Henry Kissinger to Paul Wolfowitz et. al., are equally consigned to Guantanamo Bay, all of their considerable wealth and fortunes confiscated, and the monumental criminals of humanity among them – as determined in trials similar to the one accorded to Eichmann in Jerusalem by his surviving victims and their families – are given full 'enemy combatant' protocol, America's democracy is only the Godfather's democracy! The 'sons' quietly takes over from the forcibly retired father, but with the full team intact, with all the financiers, power-brokers and puppetmasters still closely holding the strings, and all are ready to go back into the global business of “full spectrum dominance” and the “new world order” of “one world government” after re-constituting their family!

However, please mark these humble words: before this Administration is ever impeached, the reality which has been so systematically and painstakingly put in place over the past seven years, will surely see the COG machinery running this country. Before anyone can become a real threat to this status quo, and if the threat cannot be deflected someway, and no sacrificial lamb can be put up to soothe the anger of the plebeians seeking blood, the key harbingers of such a threat will be made to "sleep with the fishes"! All it takes is making one example – and the matters will end up right back on the treadmill!

Having said all that – which of course ought not come as a surprise to anyone except the most Polyanish – kudos to the immensely courageous David Swanson and the untiring persistent efforts of all those who are still endeavoring to 'spray this crop of weeds'! Especial kudos to the conscionable Congressman who is still able to muster the Chutzpah to attempt impeachment – knowing fully well that it will go absolutely nowhere! But at least it gets documented in the official paperwork of the Congress – for whatever that's really worth. A respite, however brief, is still better than none!

What the heck is going on in the minds of our so-called leaders in the House?

We all know there is no legitimate reason for the House Judiciary Committee to not immediately act on the Impeachment Articles brought to the House floor by Dennis Kucinich.

We all know that a majority of the American people are demanding that Impeachment hearings move forward.

Yet these elected representatives of the People's Will continue to stonewall the American People.

These elected representatives of the People's Will continue to thumb their noses at their Sworn Oaths of Office.

These elected representatives of the People's Will continue to flip the bird at the millions of Americans who throughout our history, have fought and died for the Constitution they now threaten to destroy.

By the simple act of deliberate inaction on the most pressing matter of our time, namely the destruction of our Constitutional Republic by the Bush Administration as well as our current slide towards neo-conservative fascism, our elected representatives of the People's Will have fanned the flames on the political wildfire that now threatens to consume our Constitution and our futures.

You are absolutely right Zahir, in your assessment of our need to think far beyond Impeachment. And to do this effectively, We the People must wake up to our own history. We must realize that we need to step back, take a breath, and take complete stock of what our collective options are. We have more options than most people realize, options that do not involve violence or violent revolution, because options involving the use of violence must go the way of the dinosaur.

Here are a few facts to consider during this period of reflection.

We the people are not governed by the Constitution. We the people created the Constitution in order to frame and control our people's government from becoming tyrannical.

The people's authority to frame and control government is derived from this country's founding document, the Declaration of Independence. This document is very clear on it's terms of use.

"that to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed; that whenever any form of government becomes destructive of these ends, it is the right of the people to alter or abolish it, & to institute new government, laying it's foundation on such principles, & organizing it's powers in such form, as to them shall seem most likely to effect their safety & happiness...when a long train of abuses & usurpations pursuing invariably the same object, evinces a design to reduce them under absolute despotism, it is their right, it is their duty to throw off such government, & to provide new guards for their future security."

Another fact is that numerous key figures in the House have sufficient cause to be arrested for felony obstruction of justice. These same obstructing Congresspeople, by their actions, may even be guilty of treason. Article I section 6 of the American Constitution provides the authority for any sheriff, who is the highest law enforcement official in any county in this country, to legally arrest members of Congress. It reads the following.

"Sect. 6. The Senators and Representatives shall receive a compensation for their services, to be ascertained by law, and paid out of the treasury of the United States. They shall in all cases, except treason, felony and breach of peace, be privileged from arrest during their attendance at the session of their respective Houses, and in going to and returning from the same; and for any speech or debate in either House, they shall not be questioned in any other place."

The peoples right to act as law enforcement is protected in the Constitution of this country, as well as in the constitutions of most of the states. The peoples right to effect a citizens arrest, or otherwise resist or defend themselves against unlawful behavior regardless of any official status of the perpetrator, is absolute whenever there is no other law enforcement either willing or able to effect arrest, or when the officer(s) themselves are acting in a manner that is unlawful and counter to the unalienable rights of the people.

The principle underlying these cases is that of the sovereignty of the American people over their government. This is reaffirmed in the American Constitution in the Preamble and Article I section 1.

"WE, the PEOPLE of the UNITED
STATES, in order to form a more perfect union, establish justice, ensure domestic tranquility, provide for the common defence, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.

ARTICLE I.
Sect. 1. ALL legislative powers, herein granted, shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives."

The important word there is "granted", and that it is the people that are doing the granting. In legal constructs, privileges are granted and based on authority delegated to it by a higher power, whereas rights are inherent and unalienable. The government does not have rights, they exist only on privileges and the authority that we choose to delegate to them in order to act on our behalf. This is further reaffirmed in my state Constitution which states the following.

"Article II, Section 1:
All political power is inherent in the people. Government is instituted for their protection, security, and benefit, and they have the right to alter or reform it, when the public good may require."

California goes further in their Constitution with Article I Section 7b which states the following.

"A citizen or class of citizens may not be granted privileges or immunities not granted on the same terms to all citizens."

The status quo will try to tell you that this was "original authority" being exercised and that we the people gave that authority up to the congress upon ratification of the new Constitution. I say to reread the Declaration of Independence, and while you're at it, read the last four pages of the following Supreme Court decision of Marbury v. Madison (1803).

"The question, whether an act, repugnant to the constitution, can become the law of the land, is a question deeply interesting to the United States; but, happily, not of an intricacy proportioned to its interest. It seems only necessary to recognise certain principles, supposed to have been long and well established, to decide it.

That the people have an original right to establish, for their future government, such principles as, in their opinion, shall most conduce to their own happiness, is the basis on which the whole American fabric has been erected. The exercise of this original right is a very great exertion; nor can it nor ought it to be frequently repeated. The principles, therefore, so established are deemed fundamental. And as the authority, from which they proceed, is supreme, and can seldom act, they are designed to be permanent.

This original and supreme will organizes the government, and assigns to different departments their respective powers. It may either stop here; or establish certain limits not to be transcended by those departments.

The government of the United States is of the latter description. The powers of the legislature are defined and limited; and that those limits may not be mistaken or forgotten, the constitution is written. To what purpose are powers limited, and to what purpose is that limitation committed to writing; if these limits may, at any time, be passed by those intended to be restrained? The distinction between a government with limited and unlimited powers is abolished, if those limits do not confine the persons on whom they are imposed, and if acts pro- [5 U.S. 137, 177] hibited and acts allowed are of equal obligation. It is a proposition too plain to be contested, that the constitution controls any legislative act repugnant to it; or, that the legislature may alter the constitution by an ordinary act.

Between these alternatives there is no middle ground. The constitution is either a superior, paramount law, unchangeable by ordinary means, or it is on a level with ordinary legislative acts, and like other acts, is alterable when the legislature shall please to alter it.

If the former part of the alternative be true, then a legislative act contrary to the constitution is not law: if the latter part be true, then written constitutions are absurd attempts, on the part of the people, to limit a power in its own nature illimitable.

Certainly all those who have framed written constitutions contemplate them as forming the fundamental and paramount law of the nation, and consequently the theory of every such government must be, that an act of the legislature repugnant to the constitution is void.

This theory is essentially attached to a written constitution, and is consequently to be considered by this court as one of the fundamental principles of our society. It is not therefore to be lost sight of in the further consideration of this subject.

If an act of the legislature, repugnant to the constitution, is void, does it, notwithstanding its invalidity, bind the courts and oblige them to give it effect? Or, in other words, though it be not law, does it constitute a rule as operative as if it was a law? This would be to overthrow in fact what was established in theory; and would seem, at first view, an absurdity too gross to be insisted on. It shall, however, receive a more attentive consideration.

It is emphatically the province and duty of the judicial department to say what the law is. Those who apply the rule to particular cases, must of necessity expound and interpret that rule. If two laws conflict with each other, the courts must decide on the operation of each. [5 U.S. 137, 178] So if a law be in opposition to the constitution: if both the law and the constitution apply to a particular case, so that the court must either decide that case conformably to the law, disregarding the constitution; or conformably to the constitution, disregarding the law: the court must determine which of these conflicting rules governs the case. This is of the very essence of judicial duty.

If then the courts are to regard the constitution; and he constitution is superior to any ordinary act of the legislature; the constitution, and not such ordinary act, must govern the case to which they both apply.

Those then who controvert the principle that the constitution is to be considered, in court, as a paramount law, are reduced to the necessity of maintaining that courts must close their eyes on the constitution, and see only the law.

This doctrine would subvert the very foundation of all written constitutions. It would declare that an act, which, according to the principles and theory of our government, is entirely void, is yet, in practice, completely obligatory. It would declare, that if the legislature shall do what is expressly forbidden, such act, notwithstanding the express prohibition, is in reality effectual. It would be giving to the legislature a practical and real omnipotence with the same breath which professes to restrict their powers within narrow limits. It is prescribing limits, and declaring that those limits may be passed at pleasure.

That it thus reduces to nothing what we have deemed the greatest improvement on political institutions-a written constitution, would of itself be sufficient, in America where written constitutions have been viewed with so much reverence, for rejecting the construction. But the peculiar expressions of the constitution of the United States furnish additional arguments in favour of its rejection.

The judicial power of the United States is extended to all cases arising under the constitution. [5 U.S. 137, 179] Could it be the intention of those who gave this power, to say that, in using it, the constitution should not be looked into? That a case arising under the constitution should be decided without examining the instrument under which it arises?

This is too extravagant to be maintained.

In some cases then, the constitution must be looked into by the judges. And if they can open it at all, what part of it are they forbidden to read, or to obey?

There are many other parts of the constitution which serve to illustrate this subject.

It is declared that 'no tax or duty shall be laid on articles exported from any state.' Suppose a duty on the export of cotton, of tobacco, or of flour; and a suit instituted to recover it. Ought judgment to be rendered in such a case? ought the judges to close their eyes on the constitution, and only see the law.

The constitution declares that 'no bill of attainder or ex post facto law shall be passed.'

If, however, such a bill should be passed and a person should be prosecuted under it, must the court condemn to death those victims whom the constitution endeavours to preserve?

'No person,' says the constitution, 'shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.'

Here the language of the constitution is addressed especially to the courts. It prescribes, directly for them, a rule of evidence not to be departed from. If the legislature should change that rule, and declare one witness, or a confession out of court, sufficient for conviction, must the constitutional principle yield to the legislative act?

From these and many other selections which might be made, it is apparent, that the framers of the consti- [5 U.S. 137, 180] tution contemplated that instrument as a rule for the government of courts, as well as of the legislature.

Why otherwise does it direct the judges to take an oath to support it? This oath certainly applies, in an especial manner, to their conduct in their official character. How immoral to impose it on them, if they were to be used as the instruments, and the knowing instruments, for violating what they swear to support!

The oath of office, too, imposed by the legislature, is completely demonstrative of the legislative opinion on this subject. It is in these words: 'I do solemnly swear that I will administer justice without respect to persons, and do equal right to the poor and to the rich; and that I will faithfully and impartially discharge all the duties incumbent on me as according to the best of my abilities and understanding, agreeably to the constitution and laws of the United States.'

Why does a judge swear to discharge his duties agreeably to the constitution of the United States, if that constitution forms no rule for his government? if it is closed upon him and cannot be inspected by him.

If such be the real state of things, this is worse than solemn mockery. To prescribe, or to take this oath, becomes equally a crime.

It is also not entirely unworthy of observation, that in declaring what shall be the supreme law of the land, the constitution itself is first mentioned; and not the laws of the United States generally, but those only which shall be made in pursuance of the constitution, have that rank.

Thus, the particular phraseology of the constitution of the United States confirms and strengthens the principle, supposed to be essential to all written constitutions, that a law repugnant to the constitution is void, and that courts, as well as other departments, are bound by that instrument.

The rule must be discharged."

Folks, we need to act as sovereigns and to think strategically beyond the "silver bullet" of Impeachment. Absolutely we must demand Impeachment. But we the people must also be willing to move and act beyond the box of Impeachment by exercising our sovereign duty and taking on the mantle of George Monbiot in the UK who is thinking strategically with citizens arrests, and have the courage to take on the war criminals ourselves.

Read and sign the Peoples Warrant for the arrest of Bush, Cheney, et al., support the People's Constitutional Convention, and let We the People regain control of our political apparatus and our government of, for, and by the people of this country.

Our children's children are counting on us.
