John Yoo has been invited to speak at 11:00 a.m. at the Miller Center and at 3:30 p.m. at Minor Hall.  The sponsors of these events are, first, the Miller Center and, second, the Federalist Society and reportedly the Burke Society, which appears to be too primitive to have any website beyond a nearly dead Facebook page that does not mention this.

Given congressional failure to subpoena Yoo, these events will be the closest he comes to speaking in Washington.

Questions to Ask Yoo:

How many testicles can a president crush, or villages massacre, or cities nuke?  Is there a limit?

Could other nations' presidents conceivably have the legal right to crush our testicles, massacre our villages, and nuke our cities?

You claim to have produced your memos under great pressure and time constraints.  Do you think that is a legal defense against a charge of conspiracy to torture?  Do you still, upon leisurely reflection support all the opinions you rendered under pressure?  Which points have you changed your mind on?

Where did that pressure come from, and was it pressure to get an answer or to get a particular answer?  Why was the Vice President's counsel involved in working with you on supposedly independent opinions?  Why were you part of a war council when your job was to offer independent interpretation of the law, not facilitate wars?

Does the Constitution provide the right to habeas corpus?

How do you get around the UN Charter's ban on aggressive war?

Do you ever feel bad about how many Iraqis have been killed and maimed?

Are you aware that conspiracy to torture is a felony under the anti-torture statute, and can you describe what an instance of that crime would look like and how it differs from your actions?

Would a member of Al Qaeda deserve the right to speak at the University of Virginia?  What about a lawyer who played a role in much greater crimes than Al Qaeda's?

You acknowledge that Congress could stop a president through impeachment or defunding, but spending funds without Congress was a power Bush assumed -- did he have that right?  And if Bush had been impeached he -- and you -- would more likely have faced swifter prosecution.  Would that have been appropriate?

Reagan's DOJ prosecuted a Texas sheriff for waterboarding.  Was that wrong?

We executed Japanese for it after WW II.  Was that wrong?

The OPR Report said (p 252) "Yoo’s legal analyses justified acts of outright torture.” You feel exonerated because they got David Margolis to say that didn't matter.  But isn't the fact that Bush's Justice Dept reached that conclusion powerful reason to begin a criminal investigation and see where it leads?

The OPR Report said: "Yoo put his desire to accommodate the client above his obligation to provide thorough, objective, and candid legal advice, and that he therefore committed intentional professional misconduct.” p. 254 A lot of evidence seems to back that up.  Do you dispute it?

The OPR Report also says: “Given Yoo’s background as a former Supreme Court law clerk and tenured professor of law, we concluded that his awareness of the complex and confusing nature of the law, his failure to carefully read the cases and his exclusive reliance on the work of a junior attorney, established by a preponderance of the evidence that he knowingly failed to present a sufficiently thorough, objective, and candid analysis of the specific intent element of the torture statute.” p. 253 Do you dispute that?

What about these:

“[Yoo] “knowingly provided incomplete and one-sided advice.” p. 252

“[Yoo] knowingly misstated the strength of the Bybee Memo’s argument ‘that interrogation of [prisoners] using methods that might violate [the torture statute] would be justified under the doctrine of self-defense....’” p. 253

“[S]ituations of great stress, danger, and fear do not relieve Department attorneys of their duty to provide thorough, objective, and candid legal advice, even if that advice is not what the client wants to hear.” p. 254

Consider this comparison and ask Yoo about it: Yoo and Jefferson.

Why do you suppose Acting Attorney General Comey refused to accept part of your legalization of warrantless spying?  What was his concern?

Why did corporations have to be given retroactive immunity if no laws were broken?
